Terms of Service

To use our API, you must create an account and generate API keys. You are responsible for:

• Maintaining the confidentiality of your API keys
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

3.1 Age Requirement

You must be at least 18 years of age to use the FormFav API service. By creating an account and generating API keys, you confirm that you are 18 years of age or older. FormFav reserves the right to request proof of age at any time and to suspend or terminate accounts where the user is found to be under 18.

3.2 Consent Process

Before generating your first API key, you are required to provide explicit consent by confirming that you are 18 or older and that you agree to these Terms of Service and our Privacy Policy. This consent is recorded and timestamped for legal compliance purposes, including your consent version, IP address, and the date of agreement. You may not use the API without providing this consent.

3.3 Withdrawal of Consent

You may withdraw your consent at any time by contacting us or deleting your account. Withdrawal of consent will result in the revocation of all active API keys and termination of your access to the service.

During the consent process, you may optionally choose to receive marketing communications from FormFav, including product updates, racing data tips, and promotional offers via email. This opt-in is entirely voluntary and is not required to use the service.

If you opt in to marketing communications:

• You may unsubscribe at any time using the link provided in every marketing email
• Your marketing preference is recorded alongside your consent record
• We will not share your email address with third parties for marketing purposes
• Marketing emails will be clearly identified as such and will not be disguised as transactional communications

Transactional emails (such as account notifications, security alerts, and service updates) are not considered marketing communications and will be sent regardless of your marketing preference.

5.1 Personal Use

Personal use is defined as non-commercial, individual use of the FormFav API for private projects, personal research, hobby applications, or educational purposes. Personal use does not generate revenue, directly or indirectly, and is not associated with any business entity, brand, product, or service offered to third parties. The Free Tier is intended exclusively for personal use.

5.2 Commercial Use

Commercial use is defined as any use of the FormFav API in connection with a business, revenue-generating activity, or any application, website, product, or service that is offered to third parties, whether for profit or not. This includes but is not limited to: websites, mobile applications, data aggregation services, tipping services, media publications, and any platform that displays or redistributes data obtained through the API.

5.3 Single-Product Commercial Licence

Each paid commercial licence is granted on a limited, non-exclusive, non-transferable, single-product basis. One commercial licence entitles the licensee to use the FormFav API for one (1) brand, application, website, or other digital product only. If you operate multiple brands, applications, websites, or products that each require access to the FormFav API, a separate paid commercial licence must be purchased for each. Sharing a single commercial licence across multiple brands, products, or entities is strictly prohibited and may result in suspension or termination of your account without refund.

Each subscription tier has specific API request limits. Exceeding your limit may result in rate limiting until your next billing cycle. We reserve the right to suspend accounts that consistently abuse rate limits.

API availability is provided on an "as-is" basis. While we strive for high availability, we do not guarantee uninterrupted access except as specified in Enterprise SLA agreements.

Free Tier: Available indefinitely with usage limits. No payment required.

Paid Subscriptions: Billed monthly or annually through Stripe. Subscriptions auto-renew unless cancelled before the renewal date. You may cancel at any time and retain access until the end of your current billing period.

FormFav does not offer, facilitate, promote, or endorse gambling in any form. Our service provides horse racing form data for informational and analytical purposes only. FormFav is not a gambling operator, wagering platform, or tipping service.

Any decision to use data obtained through the FormFav API for wagering or gambling purposes is made entirely at the user's own risk and discretion. FormFav accepts no responsibility or liability whatsoever for any financial losses, personal damages, or adverse consequences arising from gambling activities undertaken by users of this service, whether or not such activities involved data obtained through the FormFav API.

Wagering service providers: FormFav provides independent form analysis and derived statistics. It is not an official "race fields" feed. If you are a licensed wagering operator (including a bookmaker, totalisator, or betting exchange), you are solely responsible for obtaining and maintaining any race fields publication or use approvals required by the relevant racing authorities in each jurisdiction, and for sourcing official racing materials through an authorised distributor where your wagering operations require it. FormFav accepts no liability for any regulatory consequences arising from a wagering operator's use of the service without such approvals or arrangements.
